- Herbicides in Vietnam
The President has reviewed your memoranda, respectively dated September 30 and August 9, 1971,2 on the subject of Vietnamization of [Page 1007] herbicide operations. The President has also reviewed the Acting Secretary of Defense’s memorandum of November 33 regarding the use of herbicides by U.S. forces and the Secretary of State’s views as contained in his memorandum of November 18, 1971.4
The President has made the following decisions pending his review of the current Geneva Protocol5 and NSSM 1126 studies:
- —Beyond December 1, 1971, American Embassy Saigon and COMUSMACV shall have joint authority to use herbicides around U.S. bases and U.S. installations when considered essential for the protection of U.S. forces in those cases where other means are not available or satisfactory because of the presence of mines, booby traps or tactical wire. Use will continue to be restricted to these limited base and installation perimeter operations conducted only by helicopter or ground-based spray equipment under the same regulations as apply in the United States.
- —The U.S. will not take the initiative in any plans for the Vietnamization of herbicide capabilities or the provision of spray equipment and/or training and technical assistance. There should be no stimulation of the GVN to acquire or develop herbicide capabilities.
- —In the event the GVN requests assistance from COMUSMACV and American Embassy Saigon, the U.S. shall provide only that ground spray equipment determined necessary by COMUSMACV and American Embassy Saigon and presently available and not required for use by U.S. forces in Vietnam for the GVN to conduct limited herbicide operations for perimeters of fire bases and installations consistent with the guidelines established herein for U.S. operations. UC–123 aircraft, [Page 1008] related spray systems and equipment, or helicopter spray systems will not be provided.
- —If any training or technical assistance is requested, the U.S. will limit such assistance to that necessary for the perimeter operations mentioned above.
- —There will be no commitment by the U.S. Government to supply additional stocks of herbicides to the GVN.7

Tổng thống đã xem xét các biên bản ghi nhớ của ngài, lần lượt có ngày 30 tháng 9 và 9 tháng 8 năm 1971, về chủ đề Việt Nam hóa [Trang 1007] các hoạt động sử dụng thuốc diệt cỏ. Tổng thống cũng đã xem xét bản ghi nhớ ngày 33 tháng 11 của Quyền Bộ trưởng Quốc phòng về việc sử dụng chất diệt cỏ của lực lượng Hoa Kỳ và quan điểm của Bộ trưởng Ngoại giao được nêu trong bản ghi nhớ ngày 18 tháng 11 năm 1971.
Tổng thống đã đưa ra các quyết định sau đây trong khi chờ xem xét Nghị định thư Geneva hiện hành và các nghiên cứu NSSM 1126:
—Sau ngày 1 tháng 12 năm 1971, Đại sứ quán Hoa Kỳ tại Sài Gòn và COMUSMACV sẽ có thẩm quyền chung sử dụng chất diệt cỏ xung quanh các căn cứ và cơ sở của Hoa Kỳ khi được coi là cần thiết để bảo vệ lực lượng Hoa Kỳ trong những trường hợp không có hoặc không đủ các phương tiện khác do sự hiện diện của mìn, bẫy mìn hoặc dây thép gai chiến thuật. Việc sử dụng sẽ tiếp tục bị hạn chế trong các hoạt động hạn chế này, chỉ được thực hiện bằng trực thăng hoặc thiết bị phun thuốc trừ sâu trên mặt đất theo cùng các quy định áp dụng tại Hoa Kỳ. —Hoa Kỳ sẽ không chủ động trong bất kỳ kế hoạch nào nhằm Việt Nam hóa năng lực sản xuất thuốc diệt cỏ hoặc cung cấp thiết bị phun thuốc và/hoặc đào tạo và hỗ trợ kỹ thuật. Không nên khuyến khích Chính phủ Việt Nam mua sắm hoặc phát triển năng lực sản xuất thuốc diệt cỏ.
—Trong trường hợp Chính phủ Việt Nam yêu cầu hỗ trợ từ COMUSMACV và Đại sứ quán Hoa Kỳ tại Sài Gòn, Hoa Kỳ sẽ chỉ cung cấp thiết bị phun thuốc diệt cỏ trên mặt đất được COMUSMACV và Đại sứ quán Hoa Kỳ tại Sài Gòn xác định là cần thiết và hiện đang có sẵn và không bắt buộc phải sử dụng cho lực lượng Hoa Kỳ tại Việt Nam để Chính phủ Việt Nam tiến hành các hoạt động phun thuốc diệt cỏ hạn chế trong phạm vi các căn cứ hỏa lực và cơ sở phù hợp với các hướng dẫn được thiết lập tại đây cho các hoạt động của Hoa Kỳ. Máy bay UC–123, [Trang 1008] các hệ thống và thiết bị phun thuốc liên quan, hoặc hệ thống phun thuốc trực thăng sẽ không được cung cấp.
—Nếu có yêu cầu đào tạo hoặc hỗ trợ kỹ thuật, Hoa Kỳ sẽ giới hạn hỗ trợ đó ở mức cần thiết cho các hoạt động ngoại vi được đề cập ở trên.
—Chính phủ Hoa Kỳ sẽ không cam kết cung cấp thêm kho dự trữ thuốc diệt cỏ cho Chính phủ Việt Nam.
